Student records maintained by Denver Public Schools are subject to the protections, restrictions, and potential penalties mandated by FERPA, an acronym for the Family Educational Rights and Privacy Act. FERPA is a federal law passed by Congress in 1974, applicable to schools which receive federal funding, to protect the privacy of student education records and restrict a school district and its employees who have access to student records from disclosing student records except in limited circumstances. As a rule, a student's educational record cannot be disclosed to a third-party without the express consent of the student or parent. FERPA does however provide that a school district may disclose education records to school officials who have a legitimate educational interest in the information or document without the student's or parent's consent. A school official has a legitimate education interest if the official needs to review an education record in order to fulfill his/her professional responsibilities. Legitimate educational interest does not include simply having a curiosity about the academic record or disciplinary proceedings with regard to a student without some legitimate academic reason. Thus, all records of all students are not open to all administrators, teachers, and staff at Denver Public Schools. FERPA provides for a complaint procedure to the United States Department of Education with an ultimate sanction of withholding of federal funding from the Denver Public Schools. Further, a student or parent may seek to hold Denver Public Schools and/or individuals liable where a student record has been improperly disclosed. Therefore, administrators, teachers, staff, or students who violate FERPA may be subject to corrective or disciplinary action, including termination depending on the individual circumstances.
